Illegal Nicotine and THC Vapes: Westlake Police Bust Local Store Selling to Kids

In September 2022, concerned parents in multiple jurisdictions, from Brunswick to Bay Village, Westlake

In September 2022, concerned parents in multiple jurisdictions, from Brunswick to Bay Village, Westlake, and across Northeast Ohio, began lodging complaints about a suspicious local store allegedly selling illegal nicotine and THC vapes to children. This sparked a thorough investigation by Westlake police, uncovering a troubling operation that preyed on underage customers seeking prohibited substances.

Unveiling the Social Media Trail

According to Capt. Gerald Vogel, the investigation was fueled by tips provided by vigilant parents who noticed concerning activities on social media platforms. The store in question, Magic Flash on Center Ridge Road, owned by an 18-year-old named Khaled Askar, was reportedly promoting its products through Twitter and other online channels. This allowed potential buyers, including minors, to place orders online and then pick them up discreetly or even meet the seller at various locations.

Accusations of Dealing in Marijuana and Psychedelic Drugs

The complaints extended beyond just nicotine and THC vapes; tipsters also accused Khaled Askar of dealing in marijuana and psychedelic drugs. As the investigation deepened, Capt. Vogel and his team discovered evidence to back up these claims.

Teens Caught with Illegal Contraband

During their surveillance of the store, law enforcement caught multiple teenagers leaving with illegal contraband. One juvenile was found in possession of a glass pipe, marijuana cigars, and two tobacco vapes. A subsequent search of the premises revealed "eight sealed baggies" of marijuana, drug paraphernalia such as a vacuum sealer, and numerous vape pen cartridges.

A Store That Targeted Underage Customers

Capt. Vogel revealed that the store deliberately marketed itself as the go-to place for underage individuals to acquire illicit substances. This presented a significant concern as these products were not only unsuitable for minors but also illegal for the store to sell to them.

The Legal Response

As a result of the investigation, Khaled Askar was arrested and charged with "illegal distribution of cigarettes or other tobacco products." However, the repercussions did not end there. Westlake's law director took the matter further by filing a "complaint for declaration of a public nuisance, for preliminary injunction, and for permanent injunctive relief" with the Court of Common Pleas in Cuyahoga County. The aim was to have the store declared a nuisance by the courts and eventually shut down.

Protecting the Community and Educating Youngsters

Capt. Vogel stressed the importance of tackling this issue from both criminal and civil perspectives. The community's well-being, especially that of its youth, was at stake, necessitating a robust response. In addition to charging the teenage customers involved, they were also directed towards the Westlake Diversion Program, which seeks to educate young people about the consequences of their actions.

Ongoing Investigation

Despite the initial arrests and legal actions taken, the investigation is ongoing. The authorities remain vigilant in their efforts to uncover the full extent of the store's operations and bring any other wrongdoers to justice.
